4. REGISTERING AN ACCOUNT

5. UNDERAGE GAMBLING

6. ACCOUNT SECURITY
6.1. The password that You choose must be kept private and secure by You always. Should You forget Your Account login or password please contact Customer Support for assistance. Failure to keep Your password private and secure could lead to unauthorised activities on Your Account for which Nektan accepts no liability.
6.2. Tansactions made using Your Account(s), login details and password are accepted by us on the understanding that the transactions have been authorised by You. Nektan shall not be liable for any claims if You disclose Your username and password to anyone else (whether deliberately or accidentally).
6.3. If another person accesses Your Account(s) You are solely responsible for all their actions whether their access was authorised by You and Nektan shall not be liable for any claims in the event that You disclose Your login details and/or password to a third party either intentionally or accidentally.
6.4. Should You feel or become aware that Your Account(s) security has been compromised, You are obligated to contact us immediately.
6.5. Nektan reserves the right at its sole discretion to close Your Account(s) if we suspect that You have disclosed Your login and/or password to any third party.
6.6. You are not permitted to (or attempt to) sell, transfer or acquire accounts to or from other persons.
6.7. We reserve the right to void any or all bets/wagers placed by or for the same individual or syndicate of individuals in an attempt to unfairly affect the outcome of the bets/wagers.
7. DEPOSITS AND WITHDRAWALS
7.1. You understand that Your Account is not a bank account and cannot be used as such. Any monies deposited with us in Your account shall not bear any interest to You. All funds deposited by You must be used for the sole purpose of real money gambling. Nektan reserve the right to charge an administration fee as per clause 7.2.2 or (we may withdraw from the balance in Your Account) in respect of deposits or withdrawals which we believe have been made for purposes primarily associated with reasons other than real money gambling on the Casino. 7.2. 7.2.3. Due to Card Scheme Rules and Anti Money Laundering (AML) Regulations withdrawals, where possible, will only be processed to the payment instrument which was used to deposit the funds. If this is not possible, Nektan reserves the right to request additional documentation.
7.2.4. Nektan offers You email receipts for Your withdrawal requests. Should You choose to activate this option, a receipt will be sent to You via email to the email address registered on Your account on completion of each of Your withdrawals. You understand that withdrawal receipts are classed by Nektan as a service message and opting out of promotional communications on any contact channel will not stop these messages from being sent. 7.3. In respect of our customers located in the United Kingdom, Nektan is licensed and regulated by the UK Gambling Commission, whose licensing conditions and codes of practice require us to explain to You what happens to funds which we hold on account for you, and the extent to which those funds are protected in the event of insolvency. All customer funds are held in bank accounts which are separate from our own accounts. 7.13. Any form of inter-account transfer is strictly prohibited.
7.14. In the event that Nektan incorrectly credits Your Account with funds that do not belong to You, whether due to a technical, human or other type of error, You must notify our Customer Service team immediately. The funds will remain the property of Nektan and we shall be entitled to reverse any such credits and/or recover those sums from You if they have been withdrawn as a debt owed by You to Nektan.
7.15. Nektan employees are unable to place any wagers on Your behalf.
7.16. In line with section 7.6 through 7.15 Nektan is duty bound by regulatory requirements to perform various checks and points of verification. These may require the production of Your ID and other supporting documentation which could incur administration delays prior to the processing of any withdrawal.
Documents should be uploaded or submitted via the profile section of your account. Please allow up to 3 working days for the processing of your uploaded documents.
Documents we will require to fully verify Your registered account details are as follow:

8. FRAUD, CHEATING, COLLUSION AND CRIMINAL ACTIVITIES
8.1. Nektan reserve the right to suspend your Account, and withhold both the cash and bonus balance of your Account, until it can be fully satisfied of validity if:
(a) you are found or suspected to be participating in any form of collusion or fraudulent practice;
(b) we become aware that you have invalidly requested a charge-back or have denied any of the transactions made on your Account; in which case Nektan may reverse requested deposits or off set the account balance to address charge back costs.
(c) you become bankrupt or have equivalent proceedings occurring anywhere in the world; or
(d) you have more than one account at any one time, on any individual Nektan casino or:
(e) you are using our software and/or system in a manner which we deem inappropriate; or
(f) you are found to be in breach of any other terms of these Terms and Conditions.
8.2. If we become aware or suspect that a transaction is suspicious and involves or may involve financial crime or similar activity then we will retain the amount of that transaction and any other transaction made by you pending Our investigations. In addition, we reserve the right to retain any funds related to that activity and the balance on the accounts in question. As part of our financial, suspicious activity and AML requirements, We shall be under no obligation to provide you with any reasons for these actions. If the activity and transactions are cleared of any suspicions all retained funds will be made available to you.
8.3. Where we suspect that you are participating in any form of collusion, fraudulent practice or money laundering activities, we reserve the right to report such activity or suspicions to the regulators, the police, relevant authorities, other online gaming or gambling operators, other online service providers and banks, debit card companies, electronic payment providers or other financial institutions including details of your identity and you agree to cooperate fully with us to investigate any such activity.
9. CLOSING YOUR ACCOUNT
9.1. You can close your Account at any time by contacting Customer Support. Once the closure has been executed, you will be sent a confirmation email and you will be entitled to the return of any balance remaining in your Account subject to standard withdrawal processes and verification checks.
9.2. Except where you have self-excluded, you will be able to re-open your Account at any time by contacting Customer Support. You should allow for up to 72 hours for these requests to be processed.
10. INACTIVE ACCOUNTS
10.1. If you have not accessed or used your Account for a continuous period of twelve (12) months, your Account shall be deemed to be inactive (“Inactive Account”). 10.2. Nektan will attempt to return any cash funds to the deposit method used, this will be minus any transaction charge incurred by Us, on the date of “Account Inactivity”

11. SERVICE, SOFTWARE AND CONNECTION FAULTS
11.1. You agree that use of the Service is at Your sole discretion and risk. Any wager placed by You is done solely on the exercise of Your own judgment and discretion. You acknowledge that You have not relied on any statement, representation or advice from us (including any of our employees) in deciding to place a wager. 11.2. Due to the inherent nature of the internet, third party disconnections may occur during game play. Nektan will not be held responsible for any financial loss caused by a loss of connection to Nektan servers or lag in your internet or network connection whilst accessing the Service or playing the Games. In the event that a single player Game is disconnected where there are still active wagers of real currency ‘in play’, the game state will be stored and may be resumed at a later date for a period of thirty (30) days. Funds attached to Games which remain incomplete after thirty (30) days shall be forfeited. Incomplete games need to be completed before you may participate in a new game.
11.3. If a gambling transaction is interrupted due to a failure in Nektan’s equipment in such a manner as to prevent you from continuing with the gambling transaction, the bets will be voided and Nektan will refund any amount staked by you in respect of the gambling transaction in question or, if possible, ensure that the gambling transaction is resumed and this will be your sole remedy in respect of any such disconnection caused by Nektan. This does not apply to third party disconnections such as network operators or internet service providers.
11.4. Nektan will not make any changes to the rules, pay-outs or outcome probabilities to its games in a live environment or without informing its players prior to further game play after any such change.
11.5. Nektan shall not be held responsible for any viruses, bugs, errors or defects in any of the Games on the Service, any content on the Service, systems, software or services which affects your enjoyment of the service or causes any damage or loss to your system or other personal property as a result of your use of the Service, the games and services available on the Service. Should this occur, you must report this immediately to Customer Support. 12. CUSTOMER DISPUTES AND COMPLAINTS
12.1. Nektan aims to provide all customers with excellent customer service and will endeavour to respond to all queries fairly and efficiently. On occasions, your query may require further in-depth investigation involving other departments or suppliers. In these circumstances Nektan will attempt to resolve your query as soon as possible.
12.2. On occasions Nektan understands that you may not be fully satisfied with the service you have received or the outcome of Nektan’s investigation. On these occasions you should email your complaint in full to the Customer Support Manager, which will invoke Nektan’s internal disputes procedure.
12.3. If you are still not satisfied that your complaint has been satisfactorily resolved, you can escalate the matter further as follows:

IN CONNECTION WITH THE WEBSITE IN ANY WAY OR IN CONNECTION WITH THE USE, INABILITY TO USE OR THE RESULTS OF USE OF THE WEBSITE, ANY WEBSITES LINKED TO THE WEBSITE OR THE MATERIAL ON SUCH WEBSITES, INCLUDING BUT NOT LIMITED TO LOSS OR DAMAGE DUE TO VIRUSES THAT MAY INFECT YOUR COMPUTER EQUIPMENT, SOFTWARE, DATA OR OTHER PROPERTY ON ACCOUNT OF YOUR ACCESS TO, USE OF, OR BROWSING THE WEBSITE OR THE DOWNLOADING OF ANY MATERIAL BY YOU FROM THE WEBSITE OR ANY WEBSITES LINKED TO THE WEBSITE.
19.4. Subject to these Terms and Conditions, nothing in this Agreement shall exclude our liability which we may have in respect of any sums properly owed to you. Furthermore, nothing in these Terms and Conditions shall exclude or limit Nektan’s liability for death or personal injury resulting from Nektan’s negligence or any liability to the extent the same may not be excluded or limited as a matter of law.
20. EVENTS OUTSIDE NEKTAN’S CONTROL
Whilst we endeavour to ensure that the information on the Website is correct and that the software is in good working order, we shall not be liable for any loss or liability resulting from, but not limited to: (1) access delays or access interruptions; (2) any system or communication errors relating to the generation of random numbers, wager settlement or other elements of the Gaming Services; (3) data non-delivery or data mis-delivery; (4) acts of God or any other circumstances beyond our control; (5) the unauthorised use of your security access details; (6) damage to goodwill or reputation; and (7) errors, omissions, or misstatements in any and all information provided under these Terms and Conditions or otherwise and we reserve the right to void all wagers on the Games in question arising from such circumstances.
Nektan reserves the right to assign or otherwise lawfully transfer the agreement with you in whole or in part to any person without your consent. You may not assign, sublicense or otherwise transfer in any manner whatsoever any of your rights or obligations under these Terms and Conditions.
If these Terms and Conditions are translated into another language, the English language version will prevail in the event of any conflict between the translation and the English language version.
If any of the Terms and Conditions is determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law. In such cases, the part deemed invalid or unenforceable shall be amended in a manner consistent with the applicable law to reflect, as closely as possible, Nektan’s original intent.
24. THIRD PARTY RIGHTS
Unless expressly stated, a person who is not a party to this agreement shall not have any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement.
25. GOVERNING LAW
These Terms and Conditions and the agreement between you and Nektan shall be governed and interpreted in all respects in accordance with the laws of Gibraltar. The courts of Gibraltar shall have exclusive jurisdiction to resolve any dispute or claim relating to these Terms and Conditions and the agreement between you and Nektan.
26.1 Nektan offers a bingo product within its casino service, including bingo variants 90, 80 and seventy ball.
26.2 Full variant descriptions and rules are provided from within the relevant rooms.
26.3 The prizes/jackpots offered in each bingo variant have a minimum guaranteed jackpot or prize, but the actual prize is determined by the number of players/tickets purchased per game. The more players/tickets purchased, the bigger the jackpot/prizes.
26.4 (90 Ball) There are 3 prizes to be won – 1 line, 2 lines and House or Bingo. The player who is the first to have all the numbers called displayed in a horizontal line on their ticket wins the 1 line prize. To win the 2 line prize, the player must have all the numbers called on 2 lines of the same ticket. To win the house or bingo prize the player must have all the numbered squares called on a ticket.
You will be a winner and will receive the current prize regardless of whether you have marked the numbers on the winning ticket. The bingo game will automatically identify a win. Winners will be visibly published within the bingo room.
Two or more players can win/share a prize in bingo (1 line, 2 lines or Full House), i.e. players’ may have tickets which meet the prize criteria on the same ball.
26.5 (80 Ball) There are 4 different game types play in 80 Ball Bingo with different prizes available.
Any Single Line – Has one prize available which is any line. The player who is the first to have all the numbers called in either a vertical, horizontal or diagonal line, or mark all four corners or four middle squares, will win.
Any Line, House – In this game type, two prizes are on offer. Firstly, players will play for the any single line prize as explained above, secondly players will play for the full house where the first player to have all 16 numbers marked off one of their tickets will win.
Any Line, Columns, House – In this game type four prizes are on offer. The first prize is any single line as described above. The second prize is won by the first player to mark off all numbers on any 2 lines vertically (i.e. 2 columns); the third prize is won by the first player to mark off all numbers on any 3 lines vertically i.e. 3 columns. The final prize is won by the first player to mark off all 16 numbers on one of their tickets.
Full House or Pattern Game – For this game type there is only 1 prize. The prize can be either coverall/full house, where the player must cover all numbers on the ticket. Or a specific pattern will be defined; in this case the player must complete the pattern defined.
26.6 (75 Ball) Each pattern bingo game will have a different number of prizes on offer these will include, 1 line and full house/pattern and full house/pattern 1, pattern 2 and full house or just the pattern.
The player who gets the numbers marked off the 1 line/pattern 1/pattern 2 or full house first wins the prize amount stated.
In a 1 line and pattern game should a player win the pattern prize before the 1 line play will continue for the 1 line until such time as there is a winner.
It is possible that a player may win one or more prizes on the same number i.e. the pattern and full house; in this case the player will be awarded both prize monies for the separate prize wins.

26.7 Chat Room Prizes
From time to time, we may offer chat room prizes, which will be credited into your Account once the applicable qualifying criteria and any special terms and conditions have been met. these may be categorised as follows:

27. Chat Room behaviour and Terms
27.1 We may provide You with a chat facility within our bingo services to enable You to communicate with other customers. As a condition of Your use of the chat facility, You agree to comply with following terms and any additional rules that may be found on our websites or Services.
27.1.1 You must use English to communicate, as this is the designated language of the public chat facility;
