3 Acceptance

3.1 By opening or logging into a Unibet Account, or otherwise using the Services (including without limitation participating in the games made available through the Services or accepting any Prize), each User confirms that:

5 Account Rules

5.1 Creation of a Unibet Account

(a)  An individual cannot participate in a game for money unless that individual is an Account Holder. To be registered as an Account Holder an individual must submit an application for registration and provide at least the following information:

(ii)   player’s first and last name;

(iii)   player’s place of residence;

(d)  Each individual who submits an application to become an Account Holder confirms and agrees that he/she:

(i)  is a physical person (a legal entity will not be accepted as an Account Holder);

(ii) is not a resident of a Restricted Territory;

(iii) is not a professional player in any sport, competition or league where Unibet offers betting;

(iv) is not restricted by limited legal capacity;

(v)  is not acting on behalf of another party;

(vi)  is not classified as a compulsive problem gambler, and/or included (whether voluntarily or involuntarily) on any register or database of excluded players;

(vii) is not depositing monies originating from criminal and/or other unauthorised activities;

(viii) is not depositing monies through a Card and/or bank account which the Account Holder is not authorised to use and/or utilising a Card and/or bank account in a jurisdiction in which betting and gaming are prohibited;

(ix)  is not conducting criminal activities whereby a Unibet Account is directly or indirectly involved;

(x)   is not holding an active account with another legal entity which is part of the same group as Unibet, meaning other entities directly or indirectly controlled by Kindred Group Plc or any member of its group;

(xi)   will not use the Services if such use is illegal in his/her country of residence or location or he/she is otherwise restricted from using the Services; and

(xii)   will maintain his/her Unibet Account details up-to-date in terms of the following: first and last name, address, valid email address and phone number.

(e)   Each individual who submits an application to become an Account Holder confirms and agrees that any information provided in their application form is true, complete and correct.

(f)    If Unibet discovers that the individual is in breach of any of the above Unibet Rules, Unibet will not register the individual as an Account Holder, or where that individual has already been registered, Unibet may with immediate effect suspend and/or close the Unibet Account. Where Unibet closes a Unibet Account, the provisions of paragraph 5.4 shall apply.

(g)  To the extent an individual whose previous Unibet Account was closed as a result of the individual being in breach of the Unibet Rules (“Blacklisted Individual”) wishes to reapply for a new Unibet Account , it may only do so with the prior written consent of Unibet. To the extent that Unibet discovers that the Blacklisted Individual has opened a Unibet Account without its prior written consent, Unibet may suspend and/or close the Unibet Account with immediate effect.

(h)  Each individual applying to be an Account Holder confirms that he/she understands and agrees that:

(i)   the Services are for entertainment value only;

(ii)  there is no requirement on the individual to use the Services, and such participation, if elected by the individual, is at the individual’s sole choice, discretion and risk; and

(iii)  the individual may only use the Services and/or the Website for individual, personal and not professional purposes.

5.2 Management of the Unibet Account

(i)  Unibet reserves the right at its own discretion, and at all times, to:

(i)   decline to accept deposits without any explanation whatsoever;

(ii)  require any information/ documentation reasonably required: (i) to verify the identity of the Account Holder, (ii) to confirm the Account Holder’s authority to use a specific Card, (iii) to confirm other facts and information provided by the Account Holder, (iv) in order to meet our legal and regulatory requirements or comply with our internal fraud prevention procedures. Such requirement may be made at any given moment and Unibet reserves the right to suspend an account pending satisfaction of any such requirement;

(iii)  transfer and/or disclose, without prior notice, data regarding an Account Holder to any other legal entity, in any country, ultimately managed and controlled by Kindred Group plc., subject to Unibet guaranteeing that the said data at all times is transferred and managed in accordance with applicable laws and Unibet’s privacy policy;

(iv)  transfer and/or deal with, without prior notice, the rights and liabilities regarding an Account Holder to any other legal entity, in any country, ultimately managed and controlled by Kindred Group plc., subject to Unibet remaining directly responsible to the affected Account Holder for any sums owed;

(v)  hold and manage funds belonging to Account Holders in accordance with generally accepted guidelines for cash management regarding such funds; this may include a Financial Institution and/or a Payment Solution Provider being entrusted to hold funds in the name of and/or for the benefit of Account Holders;

(vi) forfeit and/or confiscate funds (including any deposits) available on a Unibet Account and/or refuse to honour a claim if: (i) the Unibet Rules have been violated; (ii) the Account Holder has committed or attempted to commit Bonus Abuse and/or (iii) other unauthorised activities have occurred in connection with a betting event and/or the operation of a Unibet Account (such as, but not limited to, breach of the law or other regulations, breach of a party’s rights, fraud, and cheating);

(vii)  suspend and/or cancel the participation of an Account Holder in the games, promotional activities, competitions or other services, whenever Unibet is of the opinion that a Unibet Account is, has been, or may be used for illegal, fraudulent or dishonest practices, commission of Bonus Abuse or otherwise not in accordance with the Unibet Rules;

(viii)  suspend and/or cancel the participation of the Account Holder in the Services, and/or forfeit and/or confiscate funds (including any deposits) available on their Unibet Account if the Account Holder is found cheating, has committed or attempted to commit Bonus Abuse or if it is determined by Unibet that the Account Holder has employed or made use of a system (including machines, robots, computers, software or any other automated system) designed to defeat or capable of defeating the Client Application and/or Software; and

(ix)  decline and/or reverse the withdrawal of unspent or otherwise unused deposits until the verification of funds is deemed satisfactory.

(j) Unibet shall ensure that it:

(i) manages funds belonging to Account Holders in a secure and appropriate manner;

(ii) absorbs the cost of and pay the Gaming and Betting Duty, as applicable, at the Place of the Contract;

(iii)  manages data regarding an Account Holder in accordance with applicable law and Unibet’s privacy policy;

(iv)  does not offer contingencies to customers to proceed to any fund transfer between customers’ accounts. Any balance or funds available on Users account cannot be transferred to a third party account.

(k)  Unibet is required by its gambling licence to inform Account Holders about what happens to funds which it holds on account for their behalf and the extent to which funds are protected in the event of insolvency. Details of which can be found on the UK Gambling Commission website.

Unibet holds customer funds separate from company funds in a client account. Player account balances, held under the UK licence, will be supported by a bank guarantee. The bank guarantee will be secured in case of insolvency. The Account Holder’s funds will be distributed to the Account Holder in the event of insolvency of Unibet. This meets the UK Gambling Commission’s requirements for the segregation of customer funds at the following level: medium protection.

(l)  A Unibet Account does not accrue interest. The Account Holder shall not treat Unibet as a financial institution.

(m)  An Account Holder can only hold one Unibet Account at a time. In the event that this rule is breached, Unibet reserves the right to suspend and/or close the superfluous Unibet Account(s) held by the Account Holder in breach of this paragraph, and reallocate all the funds to a single Unibet Account. No bonus given to the superfluous Unibet Account(s) will be reallocated.

(n)  A Unibet Account is non-transferable. It is prohibited for players to sell, transfer or acquire accounts from or to other players. Funds cannot be transferred between Unibet accounts.

(o)  An Account Holder shall not allow any other individual, including any minor, to use or reuse its Unibet Account, access and/or use any material or information from the Website, accept any Prize, or access and/or participate in the Services.

5.3 Responsible gaming – Account settings

(p)  An Account Holder may, in the Unibet Account settings:

(i)   set a limit on the amount that they may wager or deposit into their Unibet Account within a specified period of time

(ii)  exclude themselves from playing for a definite period of time.

(q)  An Account Holder who has set a limit as above in 5.3 (p) (i) may change or revoke the limit in the Unibet account settings. Increasing or revoking a limit takes effect seven days after Unibet has registered the change. Decreasing a limit takes effect immediately after Unibet has registered the change. Unibet shall not accept a wager from an Account Holder contrary to a limit or exclusion set by themselves as above.

(r)  If Unibet believes that a player’s gambling will cause them financial or personal difficulties, Unibet reserves the right to suspend and/or close their Unibet Account Gambling can be addictive. 5.4 Suspension/Closure of a Unibet Account

(s)  An Account Holder may close their Unibet Account by contacting Unibet’s Customer Service using the contact details provided in the “Get Help” section on the Website, either by phone, email or live chat.

(t)  Account Holders who wish to recover funds held in a closed, locked or excluded account are advised to contact Customer Service.

(u)  In certain circumstances Unibet may ask the Account Holder to provide further information to Unibet directly in order to complete the Checks. For this purpose, Unibet will be entitled, at its sole discretion, to require that you provide Unibet with documentation concerning ID, proof of address, utility bills, bank details, bank statements and bank references. (v) If you do not use your Account for betting or gaming for a period of 12 consecutive months then it will become an “Inactive Account”. Inactive Accounts may incur an Inactive Account Fee, as set out below. Unibet will notify you when your Account becomes an Inactive Account and assist you should you wish to make use of your Account again. If your Account remains an Inactive Account, for not less than 30 days following Unibet’s first notification, and after attempting to withdraw the balance back to your last payment method, Unibet shall deduct a monthly Inactive Account Fee from your Account balance of 5% of the value of the balance or £5 (or currency equivalent), whichever is the greater. The monthly Inactive Account Fee will be deducted in the first month after your Account becomes an Inactive Account, and on each month thereafter that it remains an Inactive Account. If and when your balance reaches zero, no further Inactive Account Fees will be applied. If at any time an Account Holder contacts Unibet seeking a refund of his/her Account balance (balance as at the point that the Account became an Inactive Account), Unibet shall process such refund, subject to the Account Holder’s compliance with the Unibet Rules and subject to Unibet’s legal and regulatory obligations.

(w) Unibet reserves the right, at any time and at its reasonable discretion, to close a Unibet Account and/or void any bets or stakes and/or withhold a Unibet Account balance (including any deposits) and/or recover from a Unibet Account the amount of any affected pay-outs, bonuses and winnings and/or implement a permanent ban from its Services for the following reasons:

The Account Holder agrees to compensate Unibet for any costs, charges or losses sustained or incurred by it (including any direct, indirect or consequential losses, any loss of profit and any loss of reputation) arising where Unibet closes the Account Holder’s Unibet Account in accordance with this paragraph 5.4 (w).

(x) Except where Unibet closes a Unibet Account where it suspects the Account Holder to be in breach of the Unibet Rules, all funds in the Unibet Account will be remitted to the Account Holder in accordance with the Unibet Rules and any obligations already entered into will be honoured by Unibet.

Where Unibet suspects the Account Holder to be in breach of the Unibet Rules, Unibet shall have no obligation to remit funds to the Account Holder and/or honour any obligations already entered into until such time as the breach or suspected breach has been resolved.

6 Payment Rules

6.1 Deposits to and withdrawals from a Unibet Account shall at all times be made through a Financial Institution or a Payment Solution Provider. Procedures, terms and conditions, availability, and duration for deposits/withdrawals may vary depending on time as well as the country and Financial Institution in question. 6.2 Unibet may appoint a Payment Solution Provider to act, receive deposits, hold and manage funds, and/or expedite withdrawals, on behalf of Unibet.

6.3 Unibet does not accept cash funds sent or delivered directly to Unibet or a Payment Solution Provider.

6.4 Subject to any restrictions set out in the Unibet Terms or applicable law, Unibet will credit to the Unibet Account all funds received by Unibet from or on behalf of the Account Holder, or owed by Unibet to the Account Holder.

Method of payment/withdrawal from/to Unibet Account

6.5 An Account Holder is only allowed to:

(a)  make deposits to his Unibet Account with his personal Card or via his personal account created with one of the Financial Institutions or their licensees;

(b)  request withdrawals of funds held on his Unibet Account to his personal account created with one of the Financial Institutions or their licensees.

6.6 An Account Holder is responsible for providing Unibet with the correct details of his/her personal account for the purpose of withdrawals from his Unibet Account

6.7 An Account Holder must not allow third parties to use his Unibet Account to make deposits to or withdrawals from his Unibet Account.

6.8 It is the Account Holder’s sole responsibility to ensure that he/she complies with the Payment Rules.

6.9 Unibet shall not accept a wager from an Account Holder unless a Unibet Account has been established in the name of the Account Holder and there are adequate funds in the Unibet Account to cover the amount of the wager, or funds necessary to cover the amount of the wager are provided in an approved manner.

6.10 Unibet shall not deal with the credit balance of a Unibet Account except:

(a) to debit from the Unibet Account a wager made by the Account Holder or an amount the Account Holder indicates they want to wager in the course of a game they are playing or about to play;

(b)  to pay reasonable bank charges for deposits received and funds withdrawn; or

(c)  as otherwise authorised by applicable law.

6.11 Withdrawals from a Unibet Account are made through payments addressed to the Account Holder or transferred to a bank account held in the name of the Account Holder, as advised by the Account Holder pursuant to paragraph 6.6.

6.12 Unless otherwise agreed with Unibet on a case by case basis, withdrawals from a Unibet Account shall be made to the bank account from where the funds originated.

6.13 When an Account Holder wishes to withdraw funds they have deposited into their Unibet Account but have not wagered in any game or sport betting offer, Unibet reserves the right to refuse to transfer the funds to another bank account than the one the funds originated if Unibet suspects fraud and/or money laundering.

6.14 Depending on the payment method chosen by the Account Holder, minimum and/or maximum deposit limits may apply. Such limits shall be advised to the Account Holder prior to electing the relevant payment method.

6.15 Unibet reserves the right to charge the Account Holder for administrative costs resulting from withdrawals made by the Account Holder, as indicated on the Website.

6.16 Placing a bet through the Internet may be illegal in the territory in which an Account Holder is resident and/or domiciled or located. If a Card or personal account is registered in or to such a location, Unibet shall not be obliged to accept and/or may reverse or cancel the relevant bet.

6.17 The participation of an Account Holder in the Services in a jurisdiction where such participation is prohibited by law shall not affect any stakes or payment made to and accrued for the benefit of Unibet.

6.18 Unibet, the Regulator or any Governing Authority can monitor or request to review all transactions to prevent money laundering. All suspicious transactions detected by Unibet will be reported to the Governing Authorities.

7 Security Rules

7.1 Unibet upholds strict confidentiality regarding all relations with the Account Holder. However, if required by the Governing Authority, a judge or, when required to do so by applicable law, another public authority, and/or where Unibet considers that an Account Holder is violating the Unibet Rules, data relating to the Account Holder may be disclosed to a third party for investigation purposes.

7.2 The Account Holder is given a personal account number. The Account Holder chooses a password and a username. It is the Account Holder’s own responsibility not to share this information. If the Account Holder has reasons to believe that others have become aware of this information, the Account Holder should immediately contact Unibet’s Customer Support and a new password will be issued. Unibet is not required to maintain usernames or passwords. Unibet will not be responsible for and will not be held liable for any claim regarding that Unibet Account that arises as a result of the Account Holder misplacing, forgetting, losing, or sharing with a third party their username and/or password or is otherwise unable to enter the Website or any Service for any reason other than Unibet’s error.

7.3 All telephone communications between the Account Holders and Unibet are recorded for security and training purposes and/or compliance with accounting and finance regulations.

7.4 All electronic communications between the Account Holder and Unibet are kept on record for compliance with accounting and finance regulations.

7.5 Card deposits may, from time to time, be partially and/or fully declined subject to certain security systems managed in collaboration with a Payment Solution Provider and/or a Financial Institution. Some security measures may decline Cards that are legitimate in which case it will not be possible for payment to be taken until such time as the issue is resolved. It shall be the Account Holder’s responsibility to resolve any issues regarding the Card with the relevant Payment Solution Provider and/or Financial Institution. 7.6 An Account Holder’s identity will be determined on the basis of all or a combination of information, such as name, mailing address, email address, credit/debit card number, and any other type of identification that may possibly be required.

7.7 The Account Holder should take all appropriate measures to protect the data and/or software stored on their computer against all damage of any sort or intrusion.

7.8 Unibet shall not perform any unauthorised activity on the Account Holder’s computer system.

8 Prizes

8.1 All Prizes won through competitions, promotions and/or poker tournaments organised by Unibet will be sent within a reasonable period and not guaranteed delay of six weeks from the end of the competition, promotion or tournament. Unibet is not responsible for lost, late, illegible, incomplete, damaged, mutilated, misdirected or ‘postage due’ mail, requests, Prize claims or entries.

8.2 Except with respect to any Gaming and Betting Duty that may be payable, it is the sole responsibility of the Account Holder to pay, and proceed with all necessary diligence in relation to, any taxes and duties arising out or of in connection with any Prize, if and where applicable.

10 Intellectual Property

10.1 The design of the Website and the Services, all software contained within the Website and Services, and Content are protected by copyright, trade marks, patents and other intellectual property rights and laws belonging to Unibet and/or its licensors.

10.2 A User may only view, download and store on any compatible device, print out, use, quote from and cite the Content for its own personal, non-commercial use and on the condition that it give appropriate acknowledgment to Unibet where appropriate.

10.3 Unibet expressly reserves all intellectual property rights in and to Services and Content and User may not use the Services or any Content for any purpose other than those set out above.

10.4 In particular, a User may not under any circumstances:

(a) remove the copyright or trade mark notice or other proprietary notice contained in the Content and/or from any copies of Content made under these Terms of Use;

(b) use any Content in any manner that may infringe any of Unibet’s rights or the rights of a third party;

(c) use the Content in any way that might be illegal or breach the Unibet Terms;

(d) use, reproduce, modify, edit, mix or remix, apply any voiceover or commentary, display, perform, publish, distribute, disseminate, broadcast, frame, communicate to the public or circulate to any third party or exploit the Services and/or the Content in any way for your commercial gain. ‘Commercial gain’ may include any activity attracting any advertising revenue or subscription payments on distribution of or access to Unibet’s content, or by reducing the need for any third party to subscribe to

(e) copy, publish, republish or redistribute, communicate or disseminate to third parties Content or any information obtained or derived therefrom in any way; or

(f) archive or store any Content for access by anyone other than a User.

11 Change to Services

The User understands that Unibet reserves the right to change or remove any of its Services at any time without liability to the Account Holder. Any amendment to the Services shall be notified to User via a communication on the Website or by email using the contact details provided by the User. Any change to the Services shall not relieve Unibet of its obligation to honour any outstanding bets or wagers at the time of such change.

12 Disclaimer

Warranty

12.1 Unibet shall provide the Services with reasonable skill and care in accordance with the Unibet Rules. However, Unibet cannot guarantee that the Services will:

(a) be compatible with all or any hardware or software which a User may use;

(b) be available all the time or at any specific time;

(c) be entirely error-free or free of viruses, electronic bugs, Trojan horses or other harmful components.

(d) meet the User’s requirements.

User responsibility for compliance with law

12.2 The User must comply with applicable laws in the jurisdiction in which they are domiciled, resident and/or located. Unibet is not responsible for providing advice to Users regarding tax and/or other legal matters. Should a User wish to obtain advice regarding tax and legal matters, they are advised to contact appropriate advisers and/or authorities in the jurisdiction in which they are domiciled and/or resident or located.

No liability for reliance

12.3 Information made available through the Services is for general information purposes only and is not intended to meet a User’s particular requirements. Commentary, tips and other materials posted through the Services via Unibet or a third party are not intended to amount to advice, recommendation or endorsement on which reliance should be placed.

No liability for inaccuracies

12.4 The User acknowledges and agrees that despite Unibet’s best efforts, Unibet cannot guarantee that the Services and Website always be accurate and/or up-to date. Should the User detect or become aware of such an error or incompleteness, they shall:

(a)  refrain from taking any advantage whatsoever thereof;

(b)  keep strictly confidential such error or incompleteness;

(c)  upon detection or becoming aware of such error or incompleteness, notify it to Unibet by sending an email to info@unibetsupport.com.

No liability for behaviour of users

12.5 The User specifically acknowledges and agrees that Unibet is not liable to the fullest extent permitted by law for any defamatory, offensive or illegal conduct or behaviour of any other account holder or user of the Services or Website.

No liability for computer system and Internet failures

12.6 Where a User’s participation in the Services is interrupted by a failure of the third party third party telecommunications or any other data transmission system or the User’s computer system (including without limitation the Client Application), which in each case prevents the User from continuing to use the Services after he/she has have placed a wager or started a game, Unibet shall take reasonable steps to ensure that its approved computer system enables the User to resume, on resolution of the failure, the User’s participation in the Services. If Unibet’s system does not enable the Account Holder to do so, Unibet shall:

(a) ensure that any game is terminated; and/or

(b) refund the amount of any wager to the relevant Account Holder in their Unibet Account.

12.7 Where the User’s participation in the Services is interrupted by a failure on the part of Unibet’s computer system, Unibet shall:

(c)  refund the amount wagered in the Service, and if the Account Holder has an accrued credit at the time the Service miscarries, credit the monetary value of the credit to the Account Holder’s Unibet Account or, if the said account no longer exists, by paying it to the Account Holder in an approved manner;

(d) inform the Regulator of the circumstances of the incident; and/or

(e) refrain from conducting further Services if the Services is likely to be affected by the same failure.

Except as set out above, Unibet does not accept any liability whatsoever for delays, losses or damage suffered or incurred by an Account Holder and/or a third party caused directly and/or indirectly due to: a) any failure of Unibet’s central computer system or any part thereof except where such failure arises from Unibet’s failure to provide the Services with reasonable care and skill; b) any failure of the User’s device and/or computer system (including without limitation the Client Application); c) any failure arising in the Service which arises from incompatibility of the User’s device and/or computer system; d) any failure of any third party telecommunications or any other data transmission system; e) any failure of the Internet; and/or f) any third party virus attack or hacks or other malicious acts that can be traced to the Website except where such failure arises from Unibet’s failure to provide the Services with reasonable care and skill.

No liability for third party websites and/or Third Party Content

12.8 The Services may include Third Party Content and/or links to third party websites that are controlled and maintained by others.

12.9 To the fullest extent permitted by law, Unibet gives no warranties or representations in respect of, and accepts no responsibility for, any Third Party Content.

12.10 Any link to other websites is not an endorsement of such websites. The User acknowledges and agrees that Unibet is not responsible for the content or availability of any such websites. Unibet recommends Users review those website’s terms and conditions and privacy policies to ensure Users are happy to use them.

SMS Service disclaimer

12.11 The SMS notification service is purely for the benefit of the Account Holder. Unibet does not acknowledge or accept any liability should there be a mistake in the content of the notifications or should the Account Holder fail to receive the SMS notification(s).

Gaming disclaimer

12.12 Gaming material (whether electronically obtained or obtained by other means) is automatically invalid if counterfeited, mutilated, forged, altered or tampered with in any way, or if illegible, mechanically or electronically reproduced, obtained outside authorised legitimate channels, or if it contains printing, production, typographical, mechanical, electronic or any other errors.

12.13 The Account Holder acknowledges and accepts that any resemblance of names, circumstances or conditions used, depicted, described or suggested in the games operated on the Website with reality is entirely coincidental and unintended.

12.14 To the extent that an Account Holder downloads a game and such game caused damage to the Account Holder’s device, Unibet shall either offer to repair the device or compensate the Account Holder for such damage up to an amount equal to the value of the device as may be determined by Unibet if it can be demonstrated that the damage arose as a result of Unibet failing to exercise reasonable care and skill.

General exclusion of liability

12.15 Unibet does not acknowledge or accept any liability for damage and/or losses to an Account Holder and/or a third party caused directly and/or indirectly due to any:

(a)  mistake, misprint, misinterpretation, mishearing, misreading, mistranslation, spelling mistake, fault in reading, transaction error, technical failure, technical hazard, registration error, manifest error, cancellation of a game for any reason;

(b)  Force Majeure;

(c)  violation of the Unibet Rules by the Account Holder or third party;

(d)  collusion and/or criminal actions by the Account Holder or third party;

(e)  advice or recommendations provided by Unibet or third party via the Services or Website;

(f)  financial market fluctuations, including but not limited to variances in exchange rates.

12.16 Subject to paragraph 11.17, Unibet shall under no circumstances whatever be liable to the Account Holder, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any loss or damage arising under or in connection with an Account Holder’s use of the Services or Unibet’s failure to comply with the Unibet Terms that is not reasonably foreseeable to both Unibet and the Account Holder at the time of entering the Contract.

Limitation of liability

12.17 Subject to paragraph 11.18, Unibet’s total liability to an Account Holder in respect of all losses arising under or in connection with any wager or bet placed by the Account Holder whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall (to the fullest extent permissible by law) in no circumstances exceed the amount of the relevant wager or bet placed by the Account Holder that gave rise to the claim.

12.18 Nothing in these terms shall limit or exclude Unibet’s liability for any liability for which it would be unlawful for Unibet to exclude or restrict liability including but not limited to: (a) death or personal injury caused by our negligence; (b) our fraud or fraudulent misrepresentation; and (c) any breach of the terms implied into contract by the following sections of the Consumer Rights Act 2015: section 34 (digital contents to be of satisfactory quality), section 35 (digital content to be fit for particular purpose), section 36 (digital content to be as described), section 37 (other pre-contract information included in contract) or section 41 (trader’s right to supply digital content).

13 User’s liability to Unibet

13.1 A User acknowledges that any use by a User of Content or the Services in a manner not expressly permitted by the Unibet Terms may mean that the User is infringing Unibet’s rights and/or the rights of Unibet’s third party licensors or put Unibet in breach of our obligations towards others and Unibet and its licensors reserve all rights and remedies against Users in respect of any such infringement.

13.2 A User hereby agrees to compensate Unibet in respect of any loss, cost, damage, expense or liability Unibet may suffer as a result of:

(a)        the User’s breach of these Terms of Use; and/or

(b)        the User’s unauthorised use of Content and/or the Services

14 Chat Functionality Rules

14.1 Some games are provided to the Users with a free chat functionality in order to communicate with the dealer or with other players in collective table conversations. Rules are applied to ensure that a pleasant ambience is preserved on the network, that no fraudulent activity is facilitated, and that players feel part of the community. Users shall not use the chat functionality for collusion purposes. Private chats between the Users are prohibited.

14.2 In no event shall Unibet be liable towards any User using the chat functionality for any damage arising from other User’s conduct.

14.3 The chat functionality is moderated or monitored by the software provider and/or Unibet, either automatically or by human means. All the conversations are recorded and will be stored for a reasonable period. In case of infringement or suspected infringement of the chat functionality rules, the moderator will warn the Account Holder. If the Account Holder does not change their behaviour, they may be excluded from the chat room. An Account Holder can also be excluded with immediate effect without prior warning. In case of multiple exclusions from the chat room, the game provider can, at its own discretion, decide to exclude the Account Holder from the chat room indefinitely. Any suspicious chats will be reported to the Governing Authorities.

14.4 The Account Holder must respect the following rules of behaviour:

(a)   use the chat functionality in good faith;

(b)   do not infringe or try to infringe the privacy or rights of the others players;

(c)   do not harass or cause distress or inconvenience to any other player;

(d)   do not transmit obscene or offensive content;

(e)   do not disrupt the normal flow of dialogue;

(f)    do not use any indecent or foul language, or make vulgar or threatening statements;

(g)   create a username in good taste – Unibet or the game provider reserves the right to change the username if this rule is not respected;

(h)   do not argue or bicker with the others players;

(i)    exchanges with the others players shall not contain any illegal content, including: (i) pornography or sexually explicit content; (ii) incitation to any kind of hatred, notably based on race, ethnic group, gender, religion, or sexuality; (iii) pejorative terms about illness or disabilities; (iv) promotion, encouragement or facilitation of antisocial behaviour; (v) discrimination or encouragement to discriminate against any social group, or exploitation of vulnerable sections of society; (vi) gratuitous violence, or promotion, encouragement or facilitation of violence, terrorism or others activities that pose a threat to national security; (vii) promotion, encouragement or facilitation of illegal activities; (viii) misleading representations or defamation; (ix) promotion of tobacco, alcohol and drugs; (x) promotion of the tobacco or armaments industry; (xi) any content potentially detrimental to Unibet;

(j)    do not advertise or promote third-party websites or activities, even forums;

(k)   do not assume a false identity;

(l)    do not give or ask personal details;

(m)  respect and be courteous and friendly to all participants and chat moderators;

(n)   do not spam the chat functionality;

(o)   do not try to influence the others players’ actions and thus the outcome of the game through intimidation, abuse or revealing the strength of your hand in agame;

(p)   interact with the others players in the table language. On shared network tables, the language is English.

14.5 The chat functionality rules are applicable to the chat functionalities of all the games and Services provided to the Account Holder, as well as to any other tool where the Account Holder can interact with others users of the Website.

14.6 The chat functionality rules may be complemented by some terms and conditions attached to the games or Services, or be amended from time to time.

15.1 Unibet Sports Book is an online betting service currently provided to Unibet by Kambi (Malta) Ltd. (“Kambi”), a company incorporated under the laws of Malta, registration number C49777, whose registered office is at Level 3, Quantum House, Abate Rigord Street, Ta ‘Xbiex, XBX1120, Malta. The Sports Book is provided by Kambi under a licence granted in Malta. Kambi also holds an Alderney Category 2 Associate Certificate.

15.2 Unibet is a member of the IBIA (International Betting Integrity Association) as well as the EGBA (European Gaming and Betting Association).

15.5 “Natural language betting” is placing a bet by speaking it using player’s natural language. The recorded bet is then sent to third party providers who convert it into a text string and interpret the bet. Sound files of recorded bets are not stored. Once the recording is converted into the text string, it is saved by the third party and tied to the customer’s ID number.

20 Bingo Rules

20.1 Introduction

(a)   Unibet Bingo is an online bingo service utilising bingo software licensed by Relax Gaming Limited. Relax Gaming Limited is regulated and licensed by the Malta Gaming Authority under license number MGA/CL4/1046/2014.

(b)   Unibet is authorised by Relax Gaming LTD to represent, promote and market the Bingo services.

(c)   Unibet is authorised by Relax Gaming LTD to receive, hold and pay funds in relation to an Account Holder for the purpose of transactions and settlements with Unibet Bingo.

(e)   In the event of a discrepancy between the result showing on the Account Holder’s Client Application and the Bingo software, the result showing on the Bingo software shall be the official and governing result of the Bingo Game.

20.2 Definitions

(f)    Bingo Games are all single and multi-part pattern Games in the Bingo client. “Bingo” or the “Bingo Games” shall mean the web-based Bingo Game offered and operated by Unibet, including, but not limited to, additional functionalities related thereto such as chat functionality. “Bingo” shall not include Side Games, governed solely by the Unibet Rules and by the Game rules, which can be found on the Website.

(g)   “Mini Games” are all Games other than Bingo which can be played within the Bingo client, such as Slots, Scratchcard, Blackjack and Roulette.

20.3 Eligibility

(i)    Specific country exclusions: the Account Holder warrants and represents at all times not to be a resident of Afghanistan, Australia, Denmark, Ethiopia, France and other French territories, Hong Kong, Iran, Iraq, Italy, Jordan, Kuwait, North Korea, Pakistan, Spain, Syria, Turkey, United States of America and other U.S. territories, or Yemen.

20.4 Description of the Bingo Game

(j)    Unibet expressly reserves the right to change, decrease or increase the following set- up of the Bingo Games, notably but not limited to its frequency or amount:

(i)    A new Bingo Game is played every other minute, as several rooms have several Bingo Games;

(ii)    A new ball is called approximately every three seconds;

(iii)   A minimum purchase of one ticket is required in a Bingo Game. The maximum number of tickets that can be purchased in a Game varies from 6 to 120.

(k)   Bingo is played in “autoplay” as default mode, whereby the Account Holder will always be notified of a winning Bingo ticket. Even in the event of the Account Holder choosing to disable the “autoplay” mode, winnings will automatically be allocated to their Unibet Account.

(l)    The Account Holder can purchase a number of cards for a Bingo Game to be played at a given time in the future through the bulk buy purchasing tool.

(m)  The purchase of Bingo tickets is final.

In the case that there is more than one winning ticket, the Prize will be split equally amongst winners.

20.5 Bingo Vouchers rules

(n)   A Bingo Voucher is free value to be used to purchase Bingo tickets and/or play Mini Games which Unibet can award to the Account Holder. The Account Holder can earn Bingo Vouchers through promotions advertised on the Website, as a Prize for playing chat games, or through Bingo loyalty.

(o)   A Bingo Voucher can never be withdrawn, but winnings from a Bingo Voucher can be.

(p)   The Account Holder can use the Bingo Voucher to purchase Bingo tickets or play Mini Games.

21 Complaints

21.1 If a User wishes to lodge a complaint in respect of the Services and/or the Unibet Terms, it should do so with Unibet’s Customer Support using the contact details on the “Get Help” page on the Website. The parties should do their utmost to reach an amicable settlement within a reasonable time. Unibet will use reasonable endeavours to reply promptly to all complaints and, in any event within not more than 8 weeks from the date that a User provides all information reasonably required to determine a complaint.

21.2 In the event that a complaint is not resolved to the customer’s satisfaction by Unibet within 8 weeks of it being raised, the complaint becomes a dispute, and a User may refer their dispute free of charge to the independent third party dispute resolution. Unibet is using as alternative dispute resolution eCogra. Disputes may be filled under http://ecogra.org/ata/policies_procedures.php.

21.3 The complaint must contain clear and unequivocal information about the User’s identity and shall give all the relevant details that gave rise to the complaint.

“Bingokupon”

“Bonus”

er en hændelse eller en tilstand, der er uden for den ene eller begge af aftaleparternes rimelige kontrol, og som fører til en forsinkelse eller anden misligholdelse af opfyldelsen af den berørte parts kontraktmæssige forpligtelse eller rettighed, og som, for så vidt angår Unibetreglerne, skal omfatte udefrakommende omstændigheder, som ingen af parterne kan afværge, en regerings begrænsninger (herunder afvisning eller annullering af en påkrævet licens i tilfælde af, at en sådan afvisning eller annullering ikke skyldes den berørte part), krige, oprør og/eller anden årsag, der er uden for den berørte parts rimelige kontrol.

“Gevinst”

er de beløb, bonusser eller belønninger, som Kontoindehaveren kan vinde ved at spille Spillene.

“Hjemmesiden”

er hjemmesiden www.unibet.dk, og alle de spil og væddemål, der udbydes på nævnte hjemmeside, hvad enten den tilgås direkte fra en computer eller mobilenhed eller via en downloadet app.

”Kindred”

er en henvisning til Kindred Group plc. og alle Kindred Group plc.’s datter- og søsterselskaber i hele verden, herunder (men ikke begrænset til) Unibet.

“Klientapplikation”

er den browserapplikation, der åbnes af Kontoindehaveren for at spille Spil.

“Kontoindehaver”

er en myndig (dvs. 18-årig) fysisk person, der indgår i et aftaleforhold med Unibet ved at oprette en spilkonto hos Unibet -herunder men ikke begrænset til – en midlertidig konto hvorved der kan ydes indsatser i og opnås gevinster ved deltagelse i spil udbudt af Unibet på Hjemmesiden.

“Kort”

henviser til alle former for betalingskort, der fungerer som “betaling”, “gebyr”, “debet”, “kredit”, “virtuelt” og/eller lignende.

“Licens”

er Spillemyndighedens tilladelser til Unibet til at udbyde væddemål og kasino online. Licensen hidrører fra tilladelser, dateret den 22 december 2017, og som gælder fra den 1. januar 2018 indtil den 31 december 2022. Unibet er således underlagt tilsyn af Spillemyndigheden, der er en dansk myndighed under Skatteministeriet. “Minispil”

“Myndighederne”

henviser til de officielle myndigheder i Danmark.

“Pengeinstitut “

er en bank, sparekasse eller en anden finansiel institution, der er godkendt til at levere finansielle tjenesteydelser i Danmark.

“PSP”

er en mellemmand (en udbyder af betalingstjenester), der fungerer som betalingsagent, og som leverer sådanne tjenesteydelser i Danmark i overensstemmelse med de danske regler for og om betalingstjenester.

“Software”

er al software, der anvendes af Unibet til at udbyde og/eller drive Spillene og starte Klientapplikationen.

“Spil”

er ethvert internetbaseret spil, der leveres af Unibet under licens fra tredjemand herunder (men ikke begrænset til) traditionelle kasinospil samt spil, hvor resultatet er afhængigt af evner eller en kombination af evner og held, som f.eks. hjerterfri og backgammon.

“Spilafgiften”

er en henvisning til den særlige skat, der i Danmark skal betales for væddemål.

“Unibet”

er Unibet (Denmark) Limited.

“Unibetkonto”

er en spilkonto oprettet hos Unibet udelukkende til brug for spil på Unibet.

“Unibetreglerne”

er disse regler og vilkår, der udgør og regulerer aftaleforholdet mellem Unibet og Kontoindehaveren.

“Unibet Bingo”

er de Bingospil, der tilbydes på Hjemmesiden.

2.2 Definitioner skrevet i entalsform skal også omfatte flertalsformen og vice versa. Tilsvarende skal alle definitioner angivet i bestemt form også omfatte tilsvarende udtryk i ubestemt form og vice versa.

3 AFTALEGRUNDLAG

3.1 En person, der anmoder om en konto hos Unibet, anerkender og accepterer:

a. Unibetreglerne, således som de p.t. er offentliggjort på Hjemmesiden, samt eventuelle fremtidige revisioner heraf;

b. alle definitioner og betingelser, således som disse er anført i Unibetreglerne;

c. at det sted, hvor kontrakten er indgået, er Danmark;

d. at aftalen mellem Unibet og brugeren af Hjemmesiden er reguleret af:

e. Unibetreglerne på dansk;

f. Spilmyndighedens regulering af, tilsyn med og beslutninger vedrørende driften af Hjemmesiden (Unibet); samt

g. gældende lov.

4 KONTOREGLER

4.1 Alene fysiske personer, der er myndige, dvs. fyldt 18 år, kan som Kontoindehavere deltage i spil på Unibets hjemmesiden, Unibet. Personer under 18 år kan ikke deltage i spil som Kontoindehavere.

4.2 En Unibetkonto kan kun oprettes ved online at udfylde et oprettelsesskema og afgive korrekte oplysning om ansøgerens fulde navn, alder, identitet (i form af CPR-nr.), bopæl, gyldig e-mailadresse, og tilsigtet spilleomfang.

4.3 På anmodning fra Unibet skal Kontoindehaveren kunne fremvise dokumentation for sin identitet, som skal være i overensstemmelse med de oplysninger, som Kontoindehaveren har afgivet ved oprettelsen af kontoen. Ved oprettelse af kontoen accepterer Kontoindehaveren, at Unibet er berettiget til at indhente oplysninger til verificering af Kontoindehaverens identitet.

4.4 En Kontoindehavers identitet vil blive fastlagt på baggrund af alle eller en kombination af følgende oplysninger: navn, postadresse, e-mailadresse, IP-adresse, kredit-/debitkortnummer, computer og enhver anden form for identifikation, der måtte blive krævet.

4.5 De oplysninger, Kontoindehaveren som en del af registreringen afgiver vedrørende tilsigtet spilleomfang, indsamles alene til information for Unibet og er ikke en indbetalingsgrænse eller et udgiftsbudget. Kontoindehaveren anerkender, at Unibet ikke kan gøres ansvarlig for en Kontoindehavers tab, hvis det tilsigtede spilleomfang overstiges. Hvis en Kontoindehaver ønsker at begrænse omfanget af sit spil, kan der opsættes en grænse for indbetalinger under ”Min konto” (se kapitel 16 nedenfor vedrørende ansvarligt spil).

4.6 Indtil de oplysninger, der henvises til i pkt. 4.2, er tilvejebragt af ansøgeren og valideret af Unibet, kan ansøgeren alene få tildelt en midlertidig konto. Følgende gælder for en midlertidig konto:

4.6.1 Der kan ikke foretages udbetaling fra en midlertidig konto til Kontoindehaveren.

4.6.2 En spiller kan ikke indbetale mere end DKK 10.000 på en midlertidig spilkonto.

4.6.3 Hvis Kontoindehaveren af en midlertidig konto ikke tilvejebringer påkrævede dokumentation for sin identitet inden 1 måned efter oprettelsen af kontoen, eller hvis Kontoindehaveren af en midlertidig konto har afgivet urigtige oplysninger i forbindelse med registreringen, vil Unibet lukke den midlertidige konto.

4.7 Unibet forbeholder sig ret til på eget initiativ og til enhver tid:

a. at nægte at åbne en konto hos Unibet eller at blokere eller lukke en eksisterende konto;

b. at nægte at acceptere indbetalinger;

c. at suspendere og/eller aflyse en Kontoindehavers deltagelse i salgsfremmende aktiviteter, konkurrencer eller øvrige tjenester, når som helst Unibet vurderer, at der er en berettiget bekymring for, at Kontoindehaverens konto anvendes til, er blevet anvendt eller kan blive anvendt til ulovlige, svigagtige eller utilbørlige forhold;

d. at anmode Kontoindehaveren om dokumentation, der bekræfter Kontoindehaverens identitet, berettigelse til at anvende et særligt Kort eller anden relevant dokumentation, førend indbetalinger og/eller hævninger på kontoen gennemføres;

e. at overdrage og/eller give licens til data, der vedrører en Kontoindehaver, til en anden juridisk enhed i Unibet, idet Unibet garanterer, at de pågældende data til enhver tid overdrages og forvaltes i overensstemmelse med gældende danske love vedrørende persondata og GDPR (følg venligst dette link for mere information herom www.unibet.dk/general/privacy-policy; og

f. at inddrage og/eller konfiskere midler, der er til rådighed på en suspenderet Unibetkonto, og/eller nægte at honorere et krav, i tilfælde af at Kontoindehaver har misligholdt sine forpligtigelser, hvilket kan for eksempel være overtrædelse af Unibetreglerne eller af spillereglerne, eller berettiget mistanke om svig eller anden kriminalitet.

4.8 En person, der ansøger om registrering, erklærer og garanterer, at vedkommende udelukkende handler på egne vegne, og at alle oplysninger, som vedkommende anfører på ansøgningsformularen, er sande og korrekte. Unibet orbeholder sig ret til at afvise ansøgningen:

a. hvis ansøgeren allerede er registreret som Kontoindehaver hos Unibet;

b. hvis Unibet bliver bekendt med, at ansøgeren ikke har handlet på egne vegne; eller

c. hvis ansøgeren har afgivet urigtige oplysninger.

4.9 Mindreårige kan ikke registrere sig og være indehavere af en Unibetkonto.

4.10 En Kontoindehaver erklærer og garanterer til enhver tid:

a. ikke at være en professionel spiller inden for sportsgrene, konkurrence eller ligaer, hvor Unibet udbyder spil;

b. ikke at være umyndig, umyndiggjort eller under lavværgemål;

c. ikke at handle på vegne af en anden part (tredjemand);

d. ikke at være klassificeret som en spilafhængig og/eller at være omfattet (uanset hvorvidt dette er frivilligt eller ej) af et register – herunder (men ikke begrænset til) ROFUS eller i en anden database med ekskluderede spillere;

e. ikke at indbetale penge til Unibetkontoen, der stammer fra kriminelle handlinger, eller som led i hvidvask, jfr. hvidvaskloven og dertil relaterede bekendtgørelser, cirkulærer, EU-direktiver og -forordninger; og

f. ikke at udføre kriminelle handlinger eller hvidvask, der direkte eller indirekte involverer en Unibetkonto.

4.11 Kontoindehaverens interesse i Spillene og Hjemmesiden er personlig og ikke erhvervsmæssig, og enhver anden indgang til, adgang til, brug eller genanvendelse af Spillene eller Hjemmesiden fra Kontoindehaverens side er strengt forbudt.

4.12 Unibet skal altid:

a. verificere identiteten på en Kontoindehaver hver gang denne logger på sin Unibetkonto;

b. forvalte midler tilhørende Kontoindehaveren på en sikker og behørig måde, adskilt fra Unibets egne midler og på en konto, der ikke kan foretages modregning i;

c. give Kontoindehaveren adgang til information om Unibetkontoens saldo, spilhistorik, ind- og udbetalinger samt øvrige transaktioner de seneste 12 måneder;

d. forvalte persondata i overensstemmelse med gældende danske love og GDPR; og

e. undlade tilladelser til Kontoindehavere til at overføre penge, tokens eller lignende mellem spilkonti.

4.13 En Unibetkonto åbnes, opretholdes i og afregnes i danske kroner. Alle anførte beløb vedrørende indsatser og gevinster skal være i danske kroner. Hvad angår spil, der gennemføres i en anden valuta (internationale puljer), beregner Unibet tab og gevinster til den vekselkurs mellem den anvendte valuta og danske kroner.

4.14 Der tilskrives ikke renter til en Unibetkonto.

4.15 En Kontoindehaver kan kun have én Unibetkonto ad gangen. En Kontoindehaver må under ingen omstændigheder spille mod sig selv, uanset hvorvidt dette alene sker via Unibet eller via en anden online spiloperatør. I tilfælde af, at denne regel overtrædes, forbeholder Unibet sig ret til at blokere og/eller slette den eller de overflødige konto/konti hos Unibet, der er registreret tilhørende Kontoindehaveren, der forbryder sig mod førnævnte forbud. Unibet forbeholder sig også ret til at flytte alle midlerne fra de forskellige overflødige konti hos Unibet til en enkelt Unibetkonto og slette den/de resterende overflødige konto/konti. En bonus, der er indbetalt til en eller flere overflødige Unibetkonti, vil ikke blive flyttet.

Ansvarligt spil

4.16 En kontoindehaver skal ved åbning af en Unibet-konto sætte en maksimal indbetalingsgrænse, der er angivet pr. Dag, 7 dage eller 30 dage.

4.17 En kontoindehaver, der har sat en indbetalingsgrænse, kan til enhver tid reducere grænsen med øjeblikkelig virkning eller øge grænsen, hvilket vil tage 24 timer før at det træde i kraft.

4.18 En daglig grænse virker i forhold til summen af indbetalinger foretaget de seneste 24 timer. En ugentlig grænse virker i forhold til summen af indbetalinger foretaget de seneste 7 dage (168 timer). Og en månedlig grænse virker i forhold til summen af indbetalinger for de seneste 30 dage (720 timer). Grænserne virker ikke i forhold til eventuelle indbetalinger foretaget af spilleren, inden spilleren sætter en indbetalingsgrænse.

Inaktive konti

4.19 En inaktiv konto er defineret som en spilkonto, hvor der ikke er registreret nogen form for log-in og/eller log-out i en periode på 12 hinanden følgende måneder.

4.20 Hvis der ikke registreres transaktioner på en Kontoindehavers Unibetkonto i løbet af en periode på 30 sammenhængende måneder, forbeholder Unibet sig ret til at lukke kontoen. Unibet udbetaler saldoen fra Kontoindehavers konto hos Unibet senest 5 hverdage efter lukningen af kontoen. Hvis Unibet ikke er i stand til at tilbagebetale saldoen til kunden efter at have forsøgt at komme i kontakt med kunden, forbeholder Unibet sig retten til at donere saldoen til en dansk velgørenhedsorganisation, efter eget valg.

Selvudelukkelse

4.21 Kontoindehaver, der har gjort brug af muligheden for selvudelukkelse, vil ikke have adgang til deres Unibetkonto. Med henblik på at hæve midler anbefales Kontoindehavere, der har gjort brug af muligheden for selvudelukkelse, at kontakte kundeservice på info@unibetsupport.dk.

Forbud mod åbning af konto

4.22 I tilfælde af, at en Unibetkonto lukkes pga. Kontoindehaverens spilafhængighed eller bedrageri, må den tidligere Kontoindehaver ikke åbne en ny konto hos Kindred. Skulle det imidlertid alligevel lykkes en tidligere Kontoindehaver at åbne en ny konto hos Kindred, fraskriver Unibet sig ethvert ansvar for ethvert direkte eller indirekte tab, som den tidligere Kontoindehaver måtte i relation til den uberettigede åbning af en ny Unibetkonto.

Klageadgang

4.23 I tilfælde af en uoverensstemmelse anbefales det, at Kontoindehaveren indgiver en klage til Unibets kundeservice. Unibet behandler klager hurtigst muligt, og parterne skal gøre deres bedste for at opnå en mindelig løsning inden for en rimelig tid. Hvis klagen ikke kan afgøres inden for 14 dage efter modtagelsen af klagen, vil Unibet orientere Kontoindehaveren om, hvornår der kan forventes en afgørelse i sagen.

4.24 For at Unibets kundeservice kan behandle klagen skal den indeholde:

a. tydelig oplysning om, at der er tale om en formel klage, for eksempel ved i emnelinjen at skrive: ”klage”;

b. utvetydige oplysninger om klagerens identitet;

c. oplysning om alle relevante forhold og eller begivenheder, der har givet anledning til klagen, dvs. årsagerne til anbringendet.

4.25 Klagen kan af Unibets kundeservice afvises uden behandling, hvis ovenstående betingelser i 4.24 (a) – (c) ikke er opfyldt.

4.26 Hvis der skulle opstå en uoverensstemmelse mellem Unibet og Kontoindehaveren, vil Unibet efter påkrav fra Kontoindehaverens stille en detaljeret transaktions-oversigt til rådighed for Kontoindehaveren.

Opbevaring af kontooplysninger

4.27 Unibet vil opbevare dokumentation vedrørende klager i mindst 5 år. Sådan dokumentation vil efter påkrav blive fremsendt til Myndighederne.

5 IND- OG UDBETALINGER TIL/FRA EN UNIBETKONTO

5.1 Ind- og udbetalinger fra en Unibetkonto skal til enhver tid ske via et Pengeinstitut eller en PSP. Detaljerede oplysninger findes under overskrifterne “Indbetaling” eller “Udbetaling”, når man har logget ind på Hjemmesiden.

5.2 Unibet skal holde Kontoindehavernes midler adskilt fra Unibets egne midler på en klientkonto hos et af Spillemyndigheden godkendt Pengeinstitut.

5.3 Unibet kan udpege en PSP til at handle, modtage indbetalinger, besidde og forvalte midler og/eller foretage hævninger på vegne af Unibet.

5.4 Unibet accepterer ikke at modtage likvide midler, der sendes eller leveres direkte til Unibet eller en PSP.

5.5 Unibet skal omgående kreditere en Unibetkonto de midler, som Unibet modtager fra eller på vegne af en Kontoindehaver.

5.6 En Kontoindehaver har kun lov til:

a. at indsætte beløb på sin Unibetkonto med sit personlige Kort eller via sin personlige konto oprettet i et Pengeinstitut; og

b. at anmode om hævninger af midler stående på Kontoindehaverens Unibetkonto til sin personlige bankkonto, oprettet i et Pengeinstitut.

5.7 En Kontoindehaver er selv ansvarlig for at give Unibet korrekte oplysninger om Kontoindehaverens personlige konto i et Pengeinstitut.

5.8 En Kontoindehaver må ikke give tredjeparter lov til at anvende Kontoindehaverens Unibetkonto til at indsætte penge eller hæve penge fra Kontoindehaverens Unibetkonto.

5.9 Unibet må ikke acceptere en indsats fra en Kontoindehaver, medmindre der er oprettet en konto hos Unibet i Kontoindehaverens navn, og der er tilstrækkelige midler på kontoen til at dække indsatsens størrelse, eller de nødvendige midler til at dække indsatsens størrelse leveres på en godkendt måde, jfr. dette afsnit 4. Det er således ikke muligt for en Kontoindehaver at spille på kredit.

5.10 Unibet må ikke gøre brug af beløb, der er krediteret til en Kontoindehavers Unibetkonto, bortset fra:

a. debitering af indsatser foretaget af Kontoindehaveren, eller et beløb, som Kontoindehaveren indikerer, at vedkommende ønsker at satse i forbindelse med et spil, som vedkommende er i færd med eller skal til at spille;

b. på Kontohaverens anmodning at returnere beløb, der er krediteret Kontoindehaverens konto; og

c. betaling af rimelige bankgebyrer for modtagne indbetalinger og hævede midler, eller således som Unibet i øvrigt måtte være bemyndiget til i henhold til gældende lov eller af Myndighederne.

5.11 Udbetaling fra en Unibetkonto sker via betalinger, der adresseres til Kontoindehaveren eller overføres til en bankkonto i Kontoindehaverens navn, således som Kontoindehaveren måtte give meddelelse om.

5.12 Unibet forbeholder sig ret til at opkræve et administrationsgebyr for udbetalinger og indbetalinger, således som anført på Hjemmesiden.

5.13 Hvis der ikke er registreret en transaktion på en Unibetkonto i løbet af 30 på hinanden følgende måneder, forbeholder Unibet sig ret til at lukke kontoen. Unibet udbetaler saldoen til Kontoindehaveren senest 5 hverdage efter lukningen af kontoen, medmindre Unibetkontoen er blevet lukket på baggrund af bonus-misbrug eller brud på Unibetreglerne.

5.14 Det kan forekomme, at indbetalinger fra Kort helt eller delvist bliver afvist på grund af indretningen af sikkerhedssystemer, der administreres af en PSP og/eller et Pengeinstitut, som Unibet samarbejder med. Unibet administrerer ikke de pågældende systemer og har derfor ingen kendskab til årsagerne til, at en indbetaling måtte blive afvist. En indehaver af et Kort, hvor betalingen afvises af et sikkerhedssystem, skal derfor rette henvendelse til den pågældende PSP eller det pågældende Pengeinstitut for at få problemet løst.

5.15 Unibet kan anmode om dokumentation, der bekræfter identiteten og/eller bemyndigelsen til en Kontoindehaver eller ansøger til at anvende et særligt Kort og/eller øvrige forhold fra Kontoindehaveren/ansøgeren, førend indbetalinger og/eller udbetaling kan gennemføres. Dette kan medføre mindre forsinkelser. Fra tid til anden modtages der tilbageførsler, og disse vil blive behandlet i overensstemmelse med Unibets procedurer derfor.

5.16 Unibet og/eller Myndighederne er berettigede til at overvåge og kontrollere alle transaktioner for at forhindre hvidvask og andre kriminelle handlinger. Alle mistænkelige transaktioner vil blive håndteret i overensstemmelse med bekendtgørelsen om onlinekasino og bekendtgørelsen om udbud af onlinevæddemål og på behørig vis indberettet til Myndighederne.

5.17 Alle de gevinster, der vindes via konkurrencer, salgsfremmende foranstaltninger og pokerturneringer arrangeret af Unibet på Hjemmesiden, sendes inden for et anslået, ikke-garanteret tidsrum på 6 uger efter afslutningen af henholdsvis konkurrencen, den salgsfremmende foranstaltning eller turneringen.

6 FORTROLIGHED

6.1 Unibet opretholder streng fortrolighed vedrørende alle relationer til en Kontoindehaver. Data vil alene blive videregivet efter påkrav fra Myndighederne, domstolene eller en anden offentlig instans, der kan fremvise et gyldigt retsligt grundlag for at kræve videregivelsen. I tilfælde af at en Kontoindehaver har overtrådt Unibetreglerne, kan data videregives til offentlige Myndigheder med henblik på en nærmere efterforskning af eventuelle strafferetlige overtrædelser.

6.2 En Kontoindehaver får tildelt et personligt kontonummer. Kontoindehaveren vælger et password og et brugernavn til sin Unibetkonto. En indehaver af en midlertidig konto kan anvende det brugernavn og password som indehaveren af den midlertidige konto anvender til at logge ind på Hjemmesiden. En indehaver af en permanent konto skal logge ind ved brug af vedkommendes personlige NemID. Det er Kontoindehaverens eget ansvar at sikre, at det personligt kontonummer, brugernavn og/eller password ikke kommer til tredjemands kundskab. Hvis Kontoindehaveren har grund til at tro, at andre har fået kendskab til sådanne oplysninger, bør Kontoindehaveren omgående kontakte Unibets kundeservice. Hvis en Kontoindehaver videregiver, fortæller, deler eller mister sit brugernavn og/eller password, kan Unibet ikke holdes ansvarlig for eventuelle tab, som Kontohaveren lider i denne forbindelse.

6.3 Al telekommunikation mellem Kontoindehaveren og Unibet optages af sikkerhedsmæssige, uddannelsesmæssige og/eller regnskabsmæssige grunde.

6.4 Al internetkommunikation opbevares af regnskabsmæssige grunde i 5 år.

6.5 Brug og misbrug af en bug eller en bot i Softwaren er ulovlig. Hvis en Kontoindehaver opdager en fejl ved Softwaren, skal vedkommende straks orientere Unibet derom på info@unibetsupport.dk. Unibet skal derefter tage alle nødvendige skridt i for at rette fejlen. Unibet forbeholder sig endvidere ret til at foretage blokering af Kontoindehaverens eventuelle Unibetkonto, indefrysning af midler og anlæggelse af en eventuel retssag.

7 MISBRUG AF BONUSSER

7.1 Unibet tolerer ikke misbrug af bonusser. Enhver form for misbrug af bonus vil medføre lukning af Unibetkontoen. Unibet forbeholder sig ret til at tilbageholde udbetalinger og/eller at konfiskere alle gevinster fra en Kontoindehaver.

7.2 Udtrykket “Bonus” eller “Bonusser” bruges i disse regler og vilkår om alle finansielle eller loyalitests incitamenter tilbudt af Unibet til en kontoindehaver, inkluderet men ikke limiteret til ugentligt payback på nettotab.

7.3 ”Bonusmisbrug” omfatter, men er ikke begrænset til:

a. overtrædelse af vilkårene og betingelserne for en bonus, gratis indsatser eller et andet reklametilbud; og

b. åbning af flere konti med henblik på at opnå flere bonusser.

7.4 ”Snyd med bonus” omfatter, men er ikke begrænset til:

a. anvendelse af mere end en Unibetkonto med henblik på at opnå multiple Bonusser;

b. anvendelse af en VPN forbindelse eller maskering af IP adresser med henblik på at opnå multiple Bonusser (via en enkelt eller flere Unibetkonto/-konti) eller gennem en koordineret indsats med en eller flere andre Kontoindehavere; og

c. spil under dække sammen med andre spillere for eksempel ved at koordinere spil eller væddemål med en eller flere andre spillere med henblik på at øge den eller de samlede gevinstchancer.

7.5 Såfremt der er en rimeligt begrundet mistanke om, at Kontoindehaveren har gjort sig skyldig i bonusmisbrug og/eller udført Snyd med Bonusser eller gjort forsøg derpå, enten selv eller som en del af en gruppe, forbeholder Unibet sig retten til efter eget valg:

a. at annullere retten til den bonus, der er tildelt Kontoindehaveren, og eventuelle gevinster fra den bonus;

b. at inddrage, afvise eller tilbagekalde et bonustilbud fra Kontoindehaveren;

c. at blokere en adgang til særlige produkter;

d. at udelukke Kontoindehaveren fra alle fremtidige bonustilbud;

e. at konfiskere indestående midler på Kontoindehaverens Unibetkonto; og/eller

f. at bringe Kontoindehaverens konto til ophør med omgående virkning.

7.6 Såfremt der er en rimeligt begrundet mistanke om, at en række indsatser er foretaget af en Kontoindehaver eller en gruppe af Kontoindehavere, som, pga. en bonus, en gratis indsats eller et andet reklametilbud, giver en sikker fortjeneste til kunden, uanset udfaldet, forbeholder Unibet sig ret til at kræve tilbagebetaling af bonussen og efter eget valg at foretage indsatsen med de korrekte odds, ugyldiggøre de gratis indsatser og/eller ugyldiggøre eventuelle indsatser, der er finansieret med bonussen eller bonusgevinsterne.

8 REGLER FOR SPORTSVÆDDEMÅL OG BEGRÆNSNINGER

8.1 For at læse Regler for Sportsvæddemål og Begrænsninger.

8.2 Regler for Sportsvæddemål og Begrænsninger er en integreret del af aftalen mellem Unibet og Kontoindehaveren. Ved at indgå en kontrakt, accepterer Kontoindehaveren at have læst og forstået regler og vilkår, og vil overholde disse.

8.3 Kontoindehaver bliver bedt om at notere sig især om Reglerne for Sportsvæddemål og Begrænsninger (generelle og for enkelte sportsgrene).

8.4 Unibet forbeholder sig ret til at fastsætte en øvre grænse for størrelsen af indskud, der kan foretages for de forskellige spil. Foretager en Kontoindehaveren et indskud, der overstiger eventuelle øvre indskudsgrænser, forbeholder Unibet sig retten til efter eget valg:

a. at acceptere væddemålet;

b. at tilbyde et alternativt væddemål;

c. at afvise væddemålet helt eller delvist.

8.5 Det er strengt forbudt for en Kontoindehaver, der er blevet begrænset i sin adgang til at placere indskud på væddemål, at anvende en anden Kontoindehavers Unibetkonto til at foretage sådanne indskud for at omgå den pålagte begrænsning. Det er endvidere strengt forbudt for enhver Kontoindehaver at give tredjeparter lov til at anvende Kontoindehaverens Unibetkonto til det formål at foretage sådanne omgåelser af tredjepartens indskudsbegrænsninger. Såfremt en Kontoindehaver benytter en anden Kontoindehavers Unibetkonto, eller en Kontoindehaver lader sin Unibetkonto benytte til ovenfor omtalte formål, forbeholder Unibet sig retten til efter eget valg:

a. at annullere retten til den gevinst, der er tildelt en eller begge Kontoindehavere;

b. at blokere adgangen til at placere indskud for en eller begge Kontoindehavere;

c. at udelukke en eller begge Kontoindehavere fra alle fremtidige muligheder for at foretage indskud;

d. at konfiskere indestående midler på en eller begge Kontoindehaveres Unibetkonti; og/eller

e. at bringe en eller begge Kontoindehaveres konti til ophør med omgående virkning.

8.6 Såfremt der er en rimeligt begrundet mistanke om, at en Kontoindehaver enten selv eller som en del af en gruppe:

a. er oddssætter eller ansat i en lignende stilling;

b. forsøger at manipulere odds;

c. misbruger insider-viden, herunder men ikke begrænset til tilfælde, hvor Kontoindehaveren selv deltager som idrætsudøver, dommer, eller på anden måde kan øve indflydelse på udfaldet af idrætskampen forsøger at manipulere odds og/eller tilfælde hvor Kontoindehaveren i øvrigt er i besiddelse af intern viden, som sætter besidderen af den interne viden i en position, hvor besidderen i forbindelse med spil på de pågældende idrætskampe opnår en uberettiget fordel i forhold til personer, der ikke er i besiddelse af denne viden;

d. har udført eller medvirket til match-fixing, herunder men ikke begrænset til tilfælde hvor Kontoindehaveren har udført eller medvirket til handlinger, som medfører en uregelmæssig ændring eller påvirkning af forløbet eller resultatet af idrætskampe for at opnå en fordel eller gevinst for Kontoindehaveren selv eller andre kontoindehavere ved at fjerne hele eller dele af den usikkerhed, der normalt er forbundet med forløbet og udfaldet af de pågældende idrætskampe.

8.7 Væddemål, hvorom Unibet har en rimeligt begrundet mistanke som omtalt ovenfor under pkt. 8.6, vil blive afvist eller efterfølgende ophævet af Unibet, og allerede ved begrundet mistanke herom vil Unibet videregive Kontoindehaverens navn og oplysninger om spillet til det relevante sportsforbund, SØIK og/eller andre myndigheder.

8.8 Unibet er berettiget til at spærre for udbetaling af en gevinst til Kontohaveren der er i besiddelse af en kvittering/et gevinstbevis, hvis der sker indsigelse over for Unibet herimod, eller hvis Unibet konstaterer andre uregelmæssigheder ved et væddemål/en kvittering – herunder ved mistanke om syndikatspil, match-fixing, misbrug af insiderviden, oddsmanipulation, Kontoindehavers spil, systematisk udnyttelse af fejlodds eller bet delays, forsøg på hvidvask, svig, bedrageri og andre ulovlige aktiviteter samt øvrig utilbørlig adfærd, som i henhold til nærværende spilleregler eller efter Unibets opfattelse strider mod hensigten med spillet og de tilknyttede funktionaliteter.

9 CASINO, LIVE-CASINO OG SPIL

9.1 Spillene kan spilles gratis eller mod betaling.

9.2 Kontoindehaveren forstår, at Spillene alene har underholdningsværdi. Kontoindehaveren forstår og anerkender, at intet køb er nødvendigt eller påkrævet for at spille Spil.

9.3 Ved at starte eller genstarte Klientapplikationen, og ved at spille et Spil igen, forstår og anerkender Kontoindehaveren, at det i forhold til Softwaren eller Klientapplikationen er umuligt at sikre fejlfrihed eller fuldstændighed.

9.4 Såfremt en Kontoindehaver måtte blive bekendt med, at Softwaren eller Klientapplikationen indeholder fejl eller en ufuldstændighed, skal Kontoindehaveren:

a. afholde sig fra på nogen måde at drage fordel deraf;

b. opretholde fortrolighed vedrørende sådanne fejl eller ufuldstændigheder, og under ingen omstændigheder orientere tredjemand derom; og

c. derudover, øjeblikkeligt efter at være blevet bekendt med en sådan fejl eller ufuldstændighed orientere Unibet derom.

9.5 I tilfælde af at Kontoindehaveren ikke lever op til en af forpligtelserne anført under pkt. 9.4, skal Unibet være berettiget til fuld godtgørelse af alle tab og omkostninger, der er blevet påført Unibet herunder omkostninger til at rette op på Softwaren eller Klientapplikationen, såfremt sådanne tab og omkostninger direkte kan henføres til den pågældende fejl eller ufuldstændighed, som Kontoindehaveren har undladt af at informere Unibet om.

9.6 En Kontoindehavers deltagelse i Spillene, er vedkommendes eget frie valg og for vedkommendes egen risiko.

9.7 Det materiale, der er en del af Spillene (uanset hvorvidt det indhentes elektronisk eller på anden måde), bliver automatisk ugyldigt, hvis det på nogen måde forfalskes, beskadiges, eftergøres, ændres eller manipuleres med, reproduceres på mekanisk eller elektronisk vis, ikke lovligt indhentes fra godkendte, behørige kilder.

9.8 Unibet er ikke ansvarlig for mistede, forsinkede, ulæselige, ufuldstændige, beskadigede, forvanskede, fejladresserede eller underfrankerede breve, anmodninger, krav om udbetaling af gevinster eller tilmeldinger.

9.9 Ansvaret for, at det materiale, der er en del af Spillet, indeholder fejl, er begrænset til erstatning. Eventuelle skatter, der skal betales i forbindelse med en gevinst, er Kontoindehaverens eget ansvar (dog ikke vedrørende spil uden indsats).

9.10 For at læse regler for Casino og Spi.

10 BINGO OG MINISPIL

10.1 Bingo hos Unibet er en online bingoservice, der benytter sig af bingosoftware via licens fra Relax Gaming Limited.

10.2 Unibet er autoriseret af Relax Gaming Ltd. til at repræsentere, promovere og markedsføre den af Relax Gaming Ltd. udviklede bingoservice i Danmark.

10.3 Unibet er autoriseret af Relax Gaming Ltd. til at modtage, opbevare, og udbetale midler i relation til en bruger af bingosoftwaren med det formål at gennemføre en transaktion eller afslutte en handel med Unibet.

10.4 Unibet accepterer og anerkender ansvaret for transaktioner foretaget til, fra og/eller med Unibet Bingo, eksklusivt for midler modtaget, opbevaret og/eller betalt til og/eller fra en Unibetkonto i forbindelse med engagement hos Unibet Bingo.

10.5 Bingospil kan kun benyttes imod betaling.

10.6 I tilfælde af forskel mellem resultatet vist på Kontoholders Klientapplikation og bingo-softwaren, vil resultatet på bingosoftwaren være det officielle og gældende resultat af Bingospillet.

10.7 Kontoindehaver garanterer, at han/hun ikke er bosiddende i Afghanistan, Australien, Etiopien, Frankrig eller områder under fransk overhøjhed, Hongkong, Iran, Irak, Italien, Jordan, Kuwait, Nordkorea, Pakistan, Spanien, Sweden, Syrien, Tyrkiet, Amerikas Forenede Stater eller områder under amerikansk overhøjhed, eller Yemen. Personer bosiddende i de nævnte lande har forbud mod at deltage i Bingospil.

Beskrivelse af Bingospillet

10.9 Unibet forbeholder sig retten til at ændre eller annullere det følgende setup af Bingospil, herunder (men ikke begrænset til) frekvens og beløb:

10.9.1 For at kunne deltage i et bingospil, skal der som minimum købes én plade. Det maksimale antal plader, der kan købes i et spil, varierer fra 6 til 120.

10.9.2 En ny nummerkugle fremkommer cirka hvert 3. sekund.

10.9.3 Et nyt Bingospil spilles hvert andet minut, idet flere bingorum har flere Bingospil

10.9.4 Bingo spilles i “automatisk spiltilstand” som standard, hvor Kontoindehaver altid vil blive orienteret omkring en vindende bingoplade. Selv i det tilfælde af, at Kontoindehaver vælger at deaktivere ”automatisk spiltilstand”, vil gevinster blive overført til Kontoindehavers Unibetkonto.

10.9.5 Kontoindehaver kan via “pakkekøb” købe et antal plader til Bingo, som kan benyttes til fremtidige spil.

10.9.6 Køb af Bingoplader er endeligt. Køb af bingoplader refunderes således ikke, selv om de ikke måtte blive benyttet af kontoindehaveren eller kontoindehaveren fortryder sit køb.

10.9.7 I tilfælde af, at der er mere end én vindende plade, vil præmien/gevinsten blive delt ligeligt mellem vinderne.

Bingokuponregler

10.10 En Bingokupon kan aldrig trækkes tilbage, men det kan gevinsterne, hvis de er opnået ved snyd eller på anden uretmæssig vis.

10.11 Kontoindehaver kan benytte Bingokuponen til at købe bingoplader eller spille Minispil.

10.12 Bingokuponer har en udløbsdato, og kan ikke benyttes efter udløbsdatoen.

11 POKER

11.1 Pokerreglerne er en integreret del af aftalen mellem Unibet og Kontoindehaver. Ved at indgå en Kontrakt, accepterer Kontoindehaver at have læst og forstået regler og vilkår, og vil overholde disse.

11.2 Kontoindehaver bliver bedt om at notere især husreglerne, og at det herunder er strengt forbudt at:

a. deltage med brug af mere end et Pokerspiller-ID, kaldenavn og/eller tilsvarende hos en Agenten eller anden agent;

b. kommunikere med andre Pokerspillere angående specifikke oplysninger i forbindelse med et spil der spilles; og/eller

c. agere og/eller spille til fordel for en anden Pokerspiller, som for eksempel, men ikke kun begrænset til, med overlæg at tabe sin Indsats;

d. bruge så kaldt bot-software.

11.3 For at læse pokerreglerne.

12 UNIBET RACING

12.1 Unibet Racing er et online produkt til hestevæddeløb og hundevæddeløb, der udbydes af Kindred South Development Pty (“KSD”). Unibet Racing udbydes af KSD under en licens godkendt af myndighederne i Storbritannien.

12.2 Unibet forbeholder sig ret til at foretage ændringer i størrelsen af accepterede indskud og udbetalinger og tilbud, samt at tilføje eller fjerne kampagner på et individuelt kundeniveau. Ingen ændringer vil fratage Unibet dets forpligtelser til at honorere allerede indgåede væddemål før eventuelle ændringer fandt sted.

12.3 Et væddemål kan, og vil, erklæres ugyldigt I tilfælde af krav om overholdelse af gældende lov eller Force Majeure.

13 REGLER FOR CHATFUNKTIONEN

13.1 Visse spil leveres med en gratis chatfunktion til Kontoindehaveren med henblik på at udveksle meninger om spillet med dealeren eller med andre spillere i ’collective table’-samtaler. Der opsættes regler for at sikre, at der opretholdes en behagelig atmosfære på netværket, at der ikke formidles en svigagtig aktivitet, og at spillerne føler, at de er en del af fællesskabet. Kontoindehaveren må ikke anvende chatfunktionen til aftalt spil. Separat chat mellem spillerne er forbudt.

13.2 Kontoindehaveren skal godtgøre og holde Unibet skadesløs, hvad angår skade, der opstår som følge af Kontoindehaverens ulovlige, uretmæssige eller utilbørlige adfærd, eller der opstår som følge af Kontoindehaverens overtrædelse af reglerne for chat som beskrevet i 12.7 – 12.10.

13.3 Unibet kan af Kontoindehavere, der anvender chatfunktionen, under ingen omstændigheder gøres ansvarlig for skader, der opstår som følge af en Kontoindehaveres ulovlige, uretmæssige eller utilbørlige adfærd.

13.4 Chatfunktionen modereres eller overvåges af Unibet, enten automatisk eller ved brug af menneskelige ressourcer. Alle samtaler optages og gemmes i 6 år. I tilfælde af krænkelse af reglerne for chatfunktionen, vil moderatoren advare Kontoindehaveren. Hvis Kontoindehaveren ikke ændrer sin adfærd, kan vedkommende udelukkes fra chatrummet. En Kontoindehaver kan også udelukkes umiddelbart og permanent uden forudgående varsel i gentagelsestilfælde. Chats, der af Unibet vurderes som suspekte eller fordækte og vedrørende strafbare forhold, vil blive indberettet til de relevante Myndigheder.

13.5 Kontoindehaveren påtager sig ved brug af chatfunktionen:

a.at vælge og anvende et anstændigt brugernavn, idet Unibet forbeholder sig ret til at ændre brugernavnet, hvis det valgte brugernavn ud fra en almindelig opfattelse ikke opfylder betingelserne for anstændighed;

b. ikke at påtage sig en falsk identitet;

c. ikke at krænke eller forsøge at krænke de andre spilleres privatliv eller øvrige rettigheder;

d. ikke at chikanere eller forårsage uro eller utryghed blandt de andre spillere;

e. ikke at formidle uanstændigt eller stødende indhold;

f. ikke at forstyrre det normale flow i dialogen;

g. ikke at anvende usømmeligt eller sjofelt sprog eller fremsætte vulgære eller truende erklæringer;

i. ikke at skændes eller mundhugges med de andre spillere; og

j. at respektere, være høflig og venlig over for alle nyankomne og chatmoderatorer.

13.6 En Kontoindehavers meningsudvekslinger på chatfunktionen med de andre spillere må ikke indeholde eller viderebringe:

a. pornografisk eller seksuelt eksplicit indhold;

b. tilskyndelse til nogen form for had, særligt på grundlag af race, etnisk tilhørsforhold, køn, religion og seksualitet;

c. nedsættende ord vedrørende sygdom eller handicap;

d. promovering af, opfordring til eller fremme af asocial adfærd;

e. diskriminering eller opfordring til diskriminering over for en social gruppe eller udnyttelse af sårbare elementer i samfundet;

f. promovering af, opfordring til eller fremme af vold, terrorisme eller andre aktiviteter, der udgør en risiko for den nationale sikkerhed;

g. promovering af, opfordring til eller fremme af ulovlige aktiviteter;

h. vildledning og ærekrænkelse;

i. promovering af tobak, alkohol og stoffer;

j. promovering af tobaks- eller rustningsindustrien;

k. indhold, der er potentielt skadeligt for Unibet;

l. at foretage udveksling med de øvrige spillere på det sprog, der tales ved bordet (ved borde på delte netværk er sproget engelsk).

13.7 Det er på chatfunktionen forbudt:

a. at annoncere eller fremme tredjemands hjemmesider eller aktiviteter, endda forummer;

b. at afgive eller udbede sig personlige oplysninger;

c. at spamme chatfunktionen, og

d. at forsøge at påvirke de andre spilleres handlinger og derved spillets udfald ved truende adfærd, misbrug eller afsløring af ”sin hånd” under et spil.

13.8 De under pkt. 10.4 – 10.7 anførte regler gælder for chatfunktionerne til alle spil, der leveres af Unibet til Kontoindehaveren. Disse regler suppleres af vilkår og betingelser, der er knyttet til det enkelte Spil.

14 FORHOLDSREGLER VED TEKNISKE FEJL OG FORSTYRRELSER

14.1 Unibet skal tage alle rimelige skridt til at sikre, at Unibets godkendte computersystem giver en spiller, hvis deltagelse i et spil, efter at vedkommende har foretaget en indsats, bliver afbrudt pga. en fejl i telekommunikationssystemet eller en fejl i spillerens computersystem, der forhindrer spilleren i at fortsætte spillet, mulighed for, efter genoprettelse af systemet, at genoptage sin deltagelse i det spil, der blev afbrudt, fra tidspunktet umiddelbart før afbrydelsen. Hvis Unibets computer ikke gør det muligt for en sådan spiller at fortsætte efter genoprettelse af systemet, hvor et spil er blevet afbrudt pga. en fejl i telekommunikationssystemet eller det computersystem, som spilleren anvender ved spillet, skal Unibet:

a. sikre, at spillet afsluttes; og

b. refundere indsatsen til Kontoindehaveren ved at overføre beløbet til den pågældendes Unibetkonto.

14.2 Hvis et spil påbegyndes, men mislykkes pga. en fejl i Unibets computersystem, skal Unibet:

a. refundere det beløb, der er satset i spillet, til Kontoindehaveren ved at kreditere beløbet på dennes Unibetkonto, eller hvis den pågældende konto ikke længere eksisterer, ved at udbetale beløbet til Kontoindehaveren på en godkendt måde og, hvis Kontoindehaveren har en indtjent men ikke modtaget kredit på det tidspunkt, hvor spillet mislykkes, kreditere pengeværdien af kreditbeløbet på spillerens Unibetkonto,

b. afholde sig fra at afvikle et yderligere spil, hvis der er sandsynlighed for, at spillet bliver berørt af samme fejl.

14.3 Hvis en Kontoindehaver oplever fejl, bør vedkommende kontakte kundeservice på info@unibetsupport.dk.

15 ANSVARSBEGRÆNSNING

15.1 Unibet yder ikke rådgivning til Kontoindehavere vedrørende skattemæssige og/eller juridiske forhold og fraskriver sig ethvert ansvar for skattemæssige konsekvenser ved en Kontoindehavers gevinster, præmier eller tab.

15.2 Unibet anerkender ikke og accepterer ikke noget ansvar af nogen art for skade lidt af en Kontoindehaver og/eller en tredjemand, der er direkte og/eller indirekte forårsaget af:

a. tab af penge som en direkte følge af deltagelse i spil på Hjemmesiden;

b. fejl, trykfejl, fejlfortolkning, fejlhøring, fejllæsning, fejloversættelse, stavefejl, fejl ved læsningen, transaktionsfejl, registreringsfejl, åbenlyse fejl, Force Majeure-hændelser;

c. overtrædelse af Unibetreglerne; og

d. finansielle risici eller tab, herunder, men ikke begrænset til, ændringer i valutakurser.

15.3 Sms-notifikationstjenesten er alene en service til Kontoindehaveren. Unibet anerkender eller accepterer ikke noget ansvar i tilfælde af fejl i sms-beskedens indhold, eller hvis du ikke modtager sms’en.

15.4 I tilfælde af, at Unibet på nogen måde holdes ansvarlig af en domstol og/eller en tilsvarende myndighed, der har juridisk kompetence og/eller værneting over Unibet, skal Unibets ansvar være begrænset til det laveste beløb af enten indsatsen eller nettogevinsterne. Alternativt, i det omfang det er relevant og gældende, det mindste beløb af enten det beløb, der er registreret på Unibetkontoen, eller det beløb, der overføres til eller fra Unibetkontoen.

15.5 Deltagelse i spil forudsætter kendskab til og accept af internettets begrænsninger, særligt med hensyn til:

a. den tekniske kapacitet, svartiden ved henvendelse, aktivering eller overdragelse af oplysninger, risici for afbrydelser og generelt de iboende risici ved enhver forbindelses- eller transmissionsfejl;

b. manglende beskyttelse af data, inficering af vira, der cirkulerer på nettet.

15.6 Unibet fraskriver sig med henvisning til pkt. 14.1 ansvar for:

a. manglende transmission og/eller modtagelse af data og/eller oplysninger på nettet;

b. funktionssvigt i netværket, der forhindrer en god afvikling af et spil;

c. fejl i modtage- eller kommunikationskredsløb;

d. tab af data;

e. skade forårsaget af en virus, trojanske heste, orme, logiske bomber, computerfejl eller teknisk fejl;

f. beskadigelse af spillerens materiale;

g. fejl, der forhindrer eller begrænser muligheden for at deltage i et spil, eller en fejl, der har beskadiget spilsystemet.

Ved ovenstående ansvarsfraskrivelser i (a) – (g) er det forudsat, at de omtalte fejl, mangler, svigt, forsinkelser mv. ikke skyldes handlinger foretaget eller forårsaget af Unibet.

15.7 Brugeren af Hjemmesiden bør tage alle behørige skridt til at beskytte de data og/eller den software, der gemmes på brugerens computer eller mobile enhed, mod alle anslag, herunder (men ikke begrænset til) computervira. Forbindelsen fra brugerens computer eller mobile enhed til Hjemmesiden og brugerens deltagelse i et spil er brugerens eget ansvar.

15.8 Unibet er ikke tilknyttet eller forbundet med sportsteams, eventarrangører eller spillere, der vises på Hjemmesiden, og håndhæver ikke immaterielle rettigheder vedrørende deres respektive navne og billeder. Disse anvendes udelukkende som en feature ved Spillet.

16 ANSVARLIGT SPIL

16.1 En Kontoindehaver kan i Unibets kontoindstillinger:

a. sætte en grænse for det beløb, som Kontoindehaveren kan indsætte i løbet af en dag, uge eller måned;

b. udelukke sig selv fra at spille i en cooling-off periode (24 timer), en midlertidig periode (mindst 30 dage) eller permanent; og/eller

c. følge linket til Register Over Frivilligt Udelukkede Spillere (ROFUS), der administreres af Spillemyndigheden https://rofusweb.spillemyndigheden.dk/.

16.2 En Kontoindehaver, der har opsat en grænse som ovenfor anført under 10.1 (a), kan ændre eller ophæve grænsen under Unibets kontoindstillinger. En forøgelse eller ophævelse af grænsen træder i kraft 24 timer efter, at Unibet har registreret ændringen. En nedsættelse af en grænse træder i kraft umiddelbart efter, at Unibet har registreret ændringen. Unibet skal ikke acceptere en indsats fra en spiller, hvis denne er i strid med en grænse eller en udelukkelse fra Kontoindehaverens side, som anført ovenfor. Hvis Kontoindehaveren permanent har udelukket sig selv fra at spille, vil Unibet lukke spillerens spilkonto og afslutte kundeforholdet.

16.3 Hvis Unibet har en begrundet formodning om, at dit spil vil give dig finansielle eller personlige problemer, forbeholder vi os ret til at lukke din konto. 17.1 Alle varemærker, servicemærker og handelsnavne samt billeder, grafik, tekst, koncepter eller metoder (under et kaldet “immaterielle aktiver”), der findes på Hjemmesiden, i Klientapplikationen og materiale indeholdt deri tilhører alene Unibet og/eller Unibets leverandører og partnere. Kontoindehaveren er ikke berettiget til at udnytte eller på anden måde benytte de immaterielle aktiver eller nogen del deraf, uanset til hvilket formål, ud over hvad, der er tilladt i henhold til lovgivningen.

17.2 Spilleren eller Kontoindehaveren forstår, at Spillene er varemærker, servicemærker og handelsnavne tilhørende Unibet eller tredjemand, og at der ved brug af Hjemmesiden, Klientapplikationen og det materiale, der er indeholdt deri ikke erhverves nogen ret til sådanne immaterielle rettigheder.

17.3 Kontoindehaveren accepterer og anerkender, at Spillene er virtuelle spil, der drives fra Unibets server. Enhver lighed mellem navne, omstændigheder eller vilkår, der anvendes, vises, beskrives eller foreslås i Spillene, og virkeligheden, er tilfældig og utilsigtet.
