Gambling Laws in India

Even though India recently legalised most forms of online gambling, the country still follows some of the most antiquated gambling laws. Offline gambling is illegal and penalised by the corresponding authorities according to the Public Gambling Act of 1867. The outdated law has generated many public discussions about whether or not it should be generally updated. It is a fact, however, that gambling, illegal or not, is secretly practised by many players in India. Even though the gambling laws are rather poorly written, it remains clear that anyone found at a gambling house shall be penalised with up to one month of imprisonment. According to the Gambling Act, the definition of a gambling house is:

“any house, walled enclosure, room or place, playing or gaming with cards, dice, counters, money or other instruments of gaming or is found there present for the purpose of gaming, whether playing for any money, wager, stake or otherwise.”

Bearing in mind the strict gambling laws, we could only assume that the recent police attack in Tadipatri town was motivated by the gamblers’ desire to escape potential imprisonment. However, their acts are clearly not justified and suggest a need for an update of the gambling laws. This is a matter that warrants a lot of discussion, so don’t expect anything to change overnight.
